ACCESS SCAQMD VIOLATION DATA FOR 2010-2011

7/16/2012

Has the SCAQMD gotten soft? Alta Environmental has compiled all of the SCAQMD settlement amounts for Notice of Violations (NOVs) for the last two calendar years. After examining thousands of data points, we noticed a precipitous drop in the total settlement values:
  • 2010 Settlement Total = $14,195,971
  • 2011 Settlement Total = $5,835,669

To download tabular summaries of Alta’s analysis, click here. The summary includes graphical presentations of:
  • SC AQMD rules targeted most often
  • Fine ranges and averages for the most targeted rules
  • Incident counts per violations

I would be delighted to get your perspective on the violation trends within this survey. Do you think SCAQMD is issuing more Notices to Comply instead of NOVs in deference to the recession and/or reduced personnel? Do believe some of the rules with higher violation counts are simply easiest to observe by SCAQMD inspectors? Will the survey results help you focus your firm’s audit and compliance efforts?

Alta Environmental tracks SCAQMD regulations and violation trends to assist its Southern California manufacturing clients and their environmental attorneys. Should you be faced with an SCAQMD Notice of Violation and would like statistical information to assist with your settlement negotiations, please contact me.

Best regards,

Matt Winefield, PE, CSP
PRESIDENT
