Hazardous Waste Tank Assessment

Quick Guide to Compliance

A hazardous waste tank assessment is required by local Certified Unified Program Agency (CUPA) to certify the acceptable conditions of hazardous waste storage containers, secondary containment, and ancillary equipment based on the requirements in 22 CCR §66265.190-200. This flyer is intended to assist large quantity generators of hazardous waste on how to achieve and/or remain in compliance with the hazardous waste tank requirements.

Your facility most likely requires a hazardous waste tank assessment if:
  1. It is a Large Quantity Generator of hazardous waste, defined as generating at least 270-gallons or 2,200-pounds of hazardous waste per month, and;
  2. Hazardous waste is accumulated in stationary tanks.

Types of facilities include wastewater treatment plants, waste oil/material storage, aerospace processing facilities etc.

What does this mean for you?

If you know or suspect non-compliance with the requirements outlined in 22 CCR §66265.190-200, you must immediately take corrective action or be at risk of enforcement measures. Please call us at (562) 495-5777 with any questions or concerns regarding your facilities compliance.

Key Aspects of a hazardous waste tank assessment:
  • Reviewed and certified by an independent, qualified Professional Engineer (PE) certified in California prior to the tanks being put into service.
  • Must be performed at least once every 5 years.
  • Hazardous waste tanks must have secondary containment.
  • Daily inspections of hazardous waste tanks and ancillary equipment must be documented and retained for 3 years.
  • Spill prevention (check valves, high level shutoff, etc.) and overfill prevention (auto shutoff, audible alarm, etc.) controls must be present.
  • The written hazardous waste tank assessment must be available onsite.
